TapAway Terms of Service

Effective Date: January 1, 2025

Welcome to TapAway (“Company,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our website (https://www.tapaway.co), our NFC products, review-generation services, dashboards, and any related tools or features (collectively, the “Service”).

By purchasing, subscribing, or using TapAway in any way, you (“Customer,” “you,” or “your”) agree to be legally bound by these Terms. If you do not agree, do not use the Service.

Service Overview

TapAway provides NFC cards, digital dashboards, and software tools that allow businesses to collect and manage online reviews. We provide both physical products (TapAway cards) and subscription-based software access.

TapAway does not guarantee a specific number of reviews, customer growth, or business results. The Service is provided “as is” and “as available” for general informational and marketing-support purposes.

Eligibility

You must be at least 18 years old and legally able to enter into contracts to use TapAway. By subscribing or purchasing, you confirm that all information you provide is accurate and that you are authorized to represent the business listed in your account.

Subscriptions and Payments

  • TapAway subscriptions are billed monthly ($30/month) or annually ($300/year) through Stripe.
  • Payments renew automatically unless canceled before the next billing date.
  • By subscribing, you authorize TapAway and Stripe to automatically charge your selected payment method.
  • You may cancel anytime from your Stripe customer portal or by emailing tapawaycompany@gmail.com

All charges are in U.S. dollars (USD) unless otherwise stated.

No Refunds

All TapAway payments are non-refundable, including partial months or unused time. Once a subscription charge is processed, TapAway is under no obligation to provide refunds or credits.

Refunds will only be issued if a billing error occurred on our end (for example, a duplicate charge).

Shipping and Delivery

  • Physical TapAway cards are typically printed and shipped within 1 business day after payment and confirmation.
  • Shipping times may vary by location, carrier delays, or supply availability.
  • TapAway is not liable for delays, lost shipments, or damages caused by shipping providers.
  • Replacement cards are provided free of charge if damaged or defective upon arrival.

Use of Service

You agree to use TapAway only for lawful business purposes. You will not:

  • Use TapAway for spam, fake reviews, or review manipulation.
  • Violate Google, Yelp, or other third-party review platform terms.
  • Resell or redistribute TapAway products or dashboards without written permission.
  • Interfere with TapAway servers, data, or intellectual property.

If any misuse or fraud is detected, TapAway reserves the right to suspend or terminate your account immediately without refund.

Account Termination

TapAway may suspend or terminate your account at any time if:

  • You breach these Terms,
  • You misuse our Service,
  • Payment fails or is reversed, or
  • Required by law or a government request.

Upon cancellation or termination:

  • Your NFC cards will automatically deactivate and redirect to a “Subscription Ended” page.
  • You will no longer have access to your TapAway Dashboard.
  • TapAway is not responsible for storing or transferring any data after termination.

Intellectual Property

All content, designs, logos, and technology within TapAway are the exclusive property of TapAway. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

Your own brand assets (logos, names, etc.) remain your property, and TapAway only uses them to print or design your NFC cards.

Limitation of Liability

To the maximum extent permitted by law:

  • TapAway is not liable for any indirect, incidental, special, consequential, or punitive damages.
  • We are not responsible for loss of profits, revenue, data, or business opportunities arising from the use or inability to use the Service.
  • In no event shall TapAway’s total liability exceed the total amount paid by you in the last 3 months of your subscription.

This limitation applies whether based on contract, negligence, warranty, or any other legal theory.

No Guarantee of Results

TapAway does not guarantee that using our Service will result in new customers, revenue growth, or a specific number of positive reviews. Results vary by business, customer volume, and other factors outside TapAway’s control.

Indemnification

You agree to indemnify and hold harmless TapAway, its owners, employees, and partners from any claims, damages, liabilities, or expenses arising from:

  • Your use or misuse of TapAway,
  • Any violation of these Terms,
  • Your breach of any law or third-party rights (including Google/Yelp platform rules).

This includes covering all legal fees and costs resulting from such claims.

Disclaimer of Warranties

TapAway is provided “as is” and without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. TapAway does not guarantee uninterrupted or error-free operation of its Service.

Changes to Terms

We may update these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of TapAway after updates means you accept the new Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute shall be handled in small claims or civil court within San Bernardino County, California.

Summary

By subscribing to TapAway, you agree that TapAway is not responsible for any specific business results or losses. You use TapAway voluntarily, agree to monthly or yearly recurring billing, and understand that canceling stops service immediately. All physical cards deactivate upon cancellation, and all services are provided “as is.”
